By Ben Kingsley

It is the task of the New York State Department of Health and each county Clerk's office to safeguard Divorce Records New York. Both public offices can provide you with divorce documents dating back to January 1, 1963. However, if what you want to locate is a document of a divorce before January 1, 1963, you can only secure that at the Clerk's office.

Divorce documents in New York have two types: one is a divorce decree and the other is a divorce certificate. A divorce decree contains confidential pieces of information, like the terms and agreement of the divorce case, and they are provided only to the husband, wife, their legal representatives, and anyone who has a written consent from the court. A divorce certificate, on the other hand, reveals a few details from the documents such as the names of the husband and wife, their date of birth, place of residence, when and where the divorce took place, and others.

If you want to retrieve divorce files, you can head to the State Department of Health or at the Clerk's office and place formal request. You can also make a request through telephone, mail, or through the Internet. You will ask for a certain amount of fee for every request, which varies on what type of request you choose to use. You can pay the fees only by credit card, money order or a certified check. The retrieval process is pretty lengthy as it could reach up to a couple of weeks. Thankfully, you can choose for a priority handling, which will trim down the time that you have to wait to get the results. You can also place a request to retrieve the files of another individual. You will be given just a few details of the files but they are enough to prove the validity of a divorce.

A divorce record is required should a divorcee wish to marry again in the future. Without it, a marriage license will not be granted, and subsequently, any marriage that a divorcee will be involved in will become null and void. The record can also be used to claim assets and properties from a past marriage.

Divorce documents can also be secured from privately-owned websites. Such websites have the consent of the court to legally supply the documents to the public. It is important that a background check is performed on a certain website to check if they have a reputation of providing genuine information. This is crucial because there are fake websites that claim they can supply the genuine information too. You can refer to customer reviews to find out if previous clients have a positive feedback on them or not.

Are Divorce Records Public? They are certainly are. That is because they are considered as part of the public domain. And records that are part of the public domain can be accessed by any member of the general public if they wish to do so. However, there are certain protocols that need to be followed in terms of how the files should and can be used and anyone who does not observe them shall suffer corresponding penalties.
